Terms of Service

These Terms are a contract between you ("you," "your," the "Client") and AP Creative ("AP Creative," "we," "us," "our"). By purchasing, subscribing to, or using any of our services — including checking the box at checkout — you agree to these Terms. If you don't agree, please don't use the services.

1. What we do

AP Creative designs, builds, launches, hosts, and maintains websites for small businesses. Our offerings include:

  • Blank template — a one-time purchase of a website template file that you customize and host yourself.
  • Template + launch & care — we customize a template, launch it on your domain, and host and maintain it under a monthly care plan.
  • Full custom website — a one-of-a-kind site built for you, launched and maintained under a monthly care plan.
  • Care plans — recurring monthly (or annual) subscriptions (Starter, Growth, Pro) covering hosting, maintenance, updates, support, and a monthly strategy video call.

The specific deliverables, features, and prices of each offering are described on our website (including the pricing page) and in any order summary or proposal we provide. Those descriptions are incorporated into these Terms.

2. Eligibility & your account

You must be at least 18 years old and able to enter a binding contract. You agree to provide accurate information and to keep your contact and billing details current. You are responsible for activity that occurs under your account or order.

3. Payment

Prices are shown in U.S. dollars. By providing a payment method you authorize us (through our payment processor, Stripe) to charge the applicable one-time fees and recurring care-plan fees. We do not store your full card details — Stripe processes and stores them.

One-time launch and build fees are charged at purchase. Monthly care plans are billed in advance each month on your billing date; annual care plans are billed in advance for the year. If a payment fails, we may retry the charge and may suspend or take down your site until payment is resolved.

4. Automatic renewal & cancellation

Your care plan renews automatically. Monthly plans renew each month, and annual plans renew each year, at the then-current rate, until you cancel. We will charge your payment method on each renewal date unless you cancel before that date.

How to cancel. You may cancel at any time, by the same means you signed up — through your account/billing portal or by emailing us at the address in Section 16. There are no long-term contracts; cancellation stops future charges.

Annual renewal reminder. For annual plans, we will send you a reminder before your renewal date as required by Florida law.

No partial refunds. Cancelling stops the next charge; we do not refund the current billing period already paid. See Section 6.

5. What happens to your website when you cancel

Your site is a hosted, managed service. While you maintain an active care plan, your website is hosted and maintained by us. When your care plan ends — whether you cancel or we terminate it for non-payment — your website will be taken offline and we will stop hosting and maintaining it.

You keep your own domain name and any content, text, logos, and photos you provided. The website's design files, code, and template are not transferred to you when a care plan ends (see Section 8). If you'd like to take an exported copy of your site elsewhere, contact us — this may be available as a separate paid service at our discretion, and is not included in the care plan.

6. Refunds & the rebuild guarantee

Blank templates are digital products delivered immediately and are non-refundable once delivered.

Launch & build fees are non-refundable. Instead, we stand behind our work with a guarantee: if you don't love the site we build, we'll revise and rebuild it until you do, before it goes live. The guarantee covers rebuilding the work — it is not a refund of the launch fee.

Care plans are billed in advance and are non-refundable for the current period; cancel to stop future charges.

7. Your content & responsibilities

You will give us the materials we need to build your site (business information, text, images, logos, etc.). You represent that you own or have the right to use everything you provide, and that it does not infringe anyone's rights or violate any law. You grant us a license to use those materials to build, host, and maintain your site and, unless you ask us not to, to feature the finished site in our portfolio.

You are responsible for the accuracy and legality of your content and your business (including any claims, prices, licenses, or disclosures shown on your site).

8. Ownership & intellectual property

Yours: your domain, your brand, your logo, and the content and materials you supply remain yours.

Ours: the underlying templates, code, design systems, components, and tools we use to build and run sites — and any improvements to them — remain the property of AP Creative. Your care plan grants you a non-exclusive license to use your live website for as long as your plan is active. That license ends when your plan ends, which is why the site is taken offline at that point (Section 5). Nothing here transfers ownership of our templates, code, or tools to you.

9. Third-party services

We rely on third-party providers to deliver the services — including Stripe (payments), Vercel (hosting), Formspree (forms), Supabase (data), Google Workspace (email), and domain registrars. Your use of the services is also subject to those providers' terms, and we are not responsible for their acts, outages, or failures. Domain registration and renewal are your responsibility unless we agree otherwise in writing.

10. Acceptable use

You agree not to use the services for anything unlawful, deceptive, infringing, or harmful, and not to misuse, copy, resell, or attempt to extract our templates, code, or systems. We may suspend or terminate services for violations.

11. Disclaimers

We work hard to deliver great sites, but the services are provided "as is" and "as available." We do not guarantee that the site, hosting, or lead notifications will be uninterrupted, error-free, or secure, or that the site will produce any particular number of leads, sales, rankings, or results. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.

12. Limitation of liability

To the fullest extent permitted by law, AP Creative will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, lost leads, or business interruption. Our total liability for any claim relating to the services is limited to the amount you paid us for the services in the three (3) months before the event giving rise to the claim.

13. Indemnification

You agree to indemnify and hold harmless AP Creative from any claims, damages, or costs (including reasonable attorneys' fees) arising from your content, your business, or your breach of these Terms.

14. Changes

We may update these Terms or the services from time to time. If we make material changes, we'll post the updated Terms here with a new "Last updated" date and, where appropriate, notify you. Continuing to use the services after changes take effect means you accept them.

15. Governing law & disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute will be brought exclusively in the state or federal courts located in Hillsborough County, Florida, and you consent to that jurisdiction. If any provision is found unenforceable, the rest stays in effect.
